We understand that your trust in us is the most important asset of Hubert De Backer NV (hereinafter referred to as “HDB,” “we,” or “us”). Your privacy is therefore of essential importance to us.

This current privacy statement (hereinafter referred to as the “privacy statement”) applies to, among other things: (i) our website https://www.hdb.be (hereinafter referred to as the “website”), (ii) entering our premises, (iii) subscribing to the newsletter, and (iv) all (commercial) relationships between HDB and its customers, prospects, and business partners.

This privacy statement contains information about the personal data that HDB collects, as well as how HDB uses and processes this personal data.

HDB emphasizes that it always strives to act in accordance with the “Privacy Legislation,” namely: (i) the Belgian Privacy Act of July 30, 2018 concerning the protection of natural persons with regard to the processing of personal data, (ii) the EU Regulation 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and (iii) the (future) Belgian legislation regarding the implementation of the aforementioned Regulation or any other legislative decision that modifies it.

HDB may collect and process the following personal data:

  • Residential characteristics
  • Education and training data
  • Professional and work-related data
  • National register number / Identification number
  • Trade union membership
  • Visual recordings
  • Audio recordings / voice recordings

II. Method of collecting personal data

These personal data are collected during or in the context of:

  • Visiting the website
  • Visiting the buildings of HDB
  • Requesting a quotation
  • Placing an order
  • Your use of HDB’s services
  • Purchasing products
  • Filling out a contact form
  • Correspondence with and from HDB
  • Exchanging business cards

The personal data collected by HDB are thus expressly and voluntarily provided by you.

Providing certain personal data is (sometimes) a condition for being able to benefit from certain services. It will be indicated which data are mandatory and which are optional.

III. Use of personal data

HDB may use your personal data for the following purposes:

  • Preparing and sending a quotation
  • Execution of the agreement
  • Sending an order
  • Handling warranty claims
  • Responding to questions, complaints or comments (whether submitted via the contact form or not)
  • Sending invoices and collecting payments
  • Inclusion in the CRM tool (e.g., the customer list)
  • Follow-up after a meeting or of the agreement
  • Registration of visitors to the buildings of HDB
  • Optimizing the quality, management and content of the website
  • Compiling statistics
  • Sending newsletters
  • Sending targeted marketing and advertising, updates and promotional offers based on your communication preferences

Processing takes place on the following legal grounds, depending on the case:

  • You have given consent for the processing of your personal data for one or more specific purposes
  • The processing is necessary for the execution of the agreement with HDB or to take measures at your request prior to the conclusion of an agreement
  • The processing is necessary to comply with a legal obligation incumbent on HDB
  • The processing is necessary to protect your vital interests or those of another natural person
  • The processing is necessary for the performance of a task carried out in the public interest
  • The processing is necessary for the purposes of the legitimate interests pursued by HDB or by a third party, except where your interests or fundamental rights and freedoms requiring the protection of personal data override those interests (particularly when you are a minor)

IV. Disclosure of personal data to third parties

HDB will not disclose your personal data to third parties, unless it is necessary in the context of the execution of the agreement with HDB and its optimization (such as but not limited to the provision of services to HDB (e.g., in the context of subcontracting), the processing of (online) payments, the delivery of products or services, in the context of database management). In this context, your personal data may be disclosed to payment providers and financial institutions, software suppliers, hosting partners, cloud partners and other IT partners, transport partners and other external service providers and subcontractors, etc.

In any case, HDB undertakes to conclude a data processing agreement with these third parties, which contains the necessary guarantees regarding confidentiality and privacy compliance of your personal data.

Notwithstanding the foregoing, it is possible that HDB discloses your personal data:

  • To the competent authorities (i) when HDB is required to do so by law or in the context of a legal or future legal proceeding and (ii) to safeguard and defend our rights;
  • When HDB or almost all of its assets are acquired by a third party, in which case your personal data – collected by HDB – will be one of the transferred assets;

In all other cases, HDB will not sell, rent or pass on your personal data to third parties, unless it (i) has obtained your consent and (ii) has concluded a data processing agreement with the relevant third party, which contains the necessary guarantees regarding confidentiality and privacy compliance of your personal data.

V. Cross-border processing of personal data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient who is domiciled or has its registered office in a country not covered by an adequacy decision issued by the European Commission will be governed by one or more appropriate safeguards (as approved by the EU).

VI. Storage of personal data

Unless a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, HDB will only retain your personal data for the period necessary to achieve and fulfill the purposes described in this privacy statement under ‘Use of personal data’.

VII. Your privacy rights

In the context of the processing of your personal data, you have the following privacy rights:

Right to access your personal data;
Right to rectification, completion or update of your personal data;
Right to deletion of your personal data (‘right to be forgotten’) (HDB points out in this context that the execution of the agreement may no longer be possible or certain services may no longer be accessible or provided if you delete or have deleted certain necessary personal data);
Right to restriction of the processing of your personal data;
Right to portability of your personal data;
Right to object to the processing of your personal data.

You can in principle exercise these rights free of charge via the aforementioned form. If you no longer wish to receive newsletters or information about our products/services, you can unsubscribe at any time by clicking the “unsubscribe” button provided at the bottom of each HDB newsletter.

VIII. Security of personal data

HDB undertakes to take appropriate and reasonable physical, technological, and organizational security measures to prevent (i) unauthorized or unlawful access to your personal data, as well as (ii) loss, misuse, or alteration of your personal data.

HDB will store all personal data it has collected on-site (Temse).

Notwithstanding (i) HDB’s security policy, (ii) the checks it performs, and (iii) the actions it takes in this context, an infallible level of security cannot be guaranteed. No method of transmission or transfer via the internet nor any method of electronic storage is 100% secure, so HDB cannot guarantee absolute security in this regard.

Finally, the security of your account will also depend on the confidentiality of your password and other account information. HDB will never ask for your password, nor will you be required to disclose it yourself. If you have shared your password with a third party, this third party will gain access to your account and your personal data via your password. In that case, you are personally liable for the actions taken through the use of your account. HDB therefore strongly recommends that you change your password immediately if you discover that someone has access to your account, and contact HDB immediately.

VIIII. Update of privacy statement

HDB is entitled to update this privacy statement by placing a new version on the website. In this context, it is strongly recommended to regularly consult the websites and the relevant page where the privacy statement is displayed, to ensure that you are aware of any changes.

X. References to other websites

The website may contain hyperlinks to other websites. When you click on one of these links, you may be directed to another website or internet source that may consciously or via cookies or other technologies collect information about you. HDB bears no responsibility, liability, or authority over these other websites or internet sources, nor over their collection, use, and distribution of your personal data. You must review the privacy policy of these other websites and internet sources yourself in order to assess whether they act in accordance with the Privacy Legislation.
